Liability for services supplied by DHI Water &
Environment 1. Liability for the
subscriber’s misinterpretation of observations etc.
DHI disclaims responsibility for any
damage or loss incurred by the subscriber or any third party as a
consequence of the subscriber’s misinterpretation of observations,
forecasts or warnings etc.
2. Liability for erroneous forecasts etc.
In the event that the subscriber or
any third party incurs damage or loss as a consequence of erroneous
forecasts supplied by DHI, DHI is liable only in so far as the
subscriber/the third party can substantiate that gross negligence on
the part of DHI caused the said damage or loss. |

3. Liability for delay
or absence of personal warnings
In the event
that the subscriber or any third party incurs damage or loss as a
consequence of delay or absence of personal warnings from DHI, DHI
is liable only in so far as the subscriber/the third party can
substantiate that gross negligence on the part of DHI caused the
said damage or loss.The
following circumstances imply freedom of liability for DHI in case
such circumstances delay, hinder or prevent DHI from supplying any
services in the personal warning system: Failure, disturbances,
interruptions, delay or similar errors occurred to the transmission
of data via the communication systems used by DHI, computer virus,
theft, destruction or any other unauthorised access to or use of
DHI’s computers or the communication systems used by DHI, or any
other circumstance beyond the control of DHI, such as fire, war,
seizure, insurrection, disturbances, work stoppage or strikes etc.
4. Indirect loss
DHI disclaims liability for any
indirect loss, such as consequential loss, loss of profits or
earnings etc. |
